Les modes d’obtention du titre foncier au cameroun
Pour commencer, qu’est-ce qu’un titre foncier ?
Le titre foncier est la certification officielle de la propriété immobilière.
Les demandes d’obtention de titre foncier au Cameroun se font donc soit à partir de la transformation des actes, soit à partir du domaine national occupé ou exploité.
I- Comment faire une demande de transformation des différents actes en titre foncier ?
Elle doit être timbrée et contenir les indications suivantes :
– nom et prénoms, date et lieu de naissance, filiation, profession, domicile, situation de famille ;
– tous renseignements permettant d’identifier l’immeuble ;
– les transferts, transactions, baux, hypothèques et autres charges qui grèvent l’immeuble.
A l’appui de la demande doivent être joints, outre le plan et le procès-verbal de bornage de l’immeuble, tous les contrats et actes publics ou privés constitutifs des droits réels dont l’immatriculation est requise.
En cas de non-bornage de l’immeuble que faire ?
Si l’immeuble n’est pas borné, le Conservateur Foncier des domaines requiert son bornage aux frais du propriétaire. Le bornage est effectué en présence des voisins, par un géomètre assermenté du cadastre.
NB : Toute contestation portant sur la propriété du terrain est irrecevable.
II- Comment obtenir un titre foncier à partir du domaine national occupe ou exploite ?
Les personnes habilitées à solliciter l’obtention d’un titre foncier sur le domaine national sont :
a) les collectivités coutumières, leurs membres ou toute autre personne de nationalité camerounaise, à condition que l’occupation ou l’exploitation soit antérieure au 5 août 1974, date de publication de l’ordonnance N° 74-1 du 6 juillet 1974, fixant le régime foncier.
b) Les personnes déchues de leurs droits par application des articles 4, 5, et 6 de l’ordonnance N° 74-1 du 6 juillet 1974, fixant le régime foncier Art. 10.
NB : Les administrateurs des biens d’une succession ne peuvent obtenir en leur nom, des titres fonciers sur ces biens.
Comment constituer un dossier de demande de titre foncier sur une dépendance du domaine national ?
Toute personne habilitée à solliciter l’obtention d’un titre foncier sur une dépendance du domaine national doit constituer un dossier comprenant :
– une demande en quatre (4) exemplaires dont l’original est timbré, indiquant ses nom et prénoms, sa filiation, son domicile, sa profession, son régime matrimonial, sa nationalité, le nom sous lequel l’immeuble doit être immatriculé ;
– la description de l’immeuble (situation, superficie, nature de l’occupation ou de l’exploitation, estimation de sa valeur, indication des charges qui le grèvent).
La demande signée, ne doit viser qu’un immeuble composé d’une seule parcelle. Si une route ou une rivière traverse le terrain, celui-ci fait l’objet d’autant de demandes qu’il y a de parcelles distinctes.
NB : Les demandes portant sur les terres libres de toute occupation ou de toute exploitation sont irrecevables. Elles sont instruites selon la procédure de concession.
Suivent également la procédure de concession, les demandes portant sur des mises en valeurs réalisées après le 5 août 1974, sauf s’il est établi par la Commission consultative que ces mises en valeur étaient précédées par une occupation ou une exploitation non probante réalisées avant le 5 août 1974.
Où déposer le dossier ?
Le dossier est déposé auprès du chef de district ou du sous-préfet du lieu de situation de l’immeuble.
Que faire en cas de contestation des limites de l’immeuble ?
En cas de contestations sur les limites de l’immeuble, le géomètre assermenté fait ressortir le plan de la partie litigieuse. Le différend est porté selon le cas, soit devant le Ministre chargé des domaines qui statue en dernier ressort, s’il s’agit de terrains domaniaux (Terre appartenant à l’État), soit devant la juridiction compétente, s’il s’agit de terrains privés (terre appartenant à des particuliers ou à des entreprises).
